1. Scope

These Terms of Service apply to the use of the kinux service. By registering or using the service, you agree to these terms. The version valid at the time of use is authoritative.

3. What kinux provides

kinux is a digital information service for questions about Swiss insurance. Where stored insurance documents cover a question, the answers are based on them and name the exact passage. The range of functions is continuously developed and may change.

Important note: kinux is an information tool. The service provides neither legal advice nor insurance advice. All answers are provided without guarantee and do not replace a professional review. For decisions, the original documents are authoritative. You are responsible for having the information checked, if necessary with the help of a qualified professional, before making decisions.

4. Registration and account

Using kinux requires registration with a valid email address. You are responsible for the accuracy of your details and the confidentiality of your access credentials. Passing the account on to third parties is not permitted.

5. Trial period

New users receive a free trial period of 7 days. No payment method needs to be added for activation. The trial period ends automatically after 7 days. There is no automatic charge and no payment obligation arises. If you want to keep using kinux afterwards, you actively choose a subscription.

6. Prices and payment

After the trial period ends, the chosen plan is billed monthly. The Essential plan costs CHF 39 per month and can be cancelled monthly. Payment is processed via the payment provider Stripe, by card and later also via TWINT.

Further plans may follow. The Enterprise plan is available on request via the contact form.

Prices may change. We announce price adjustments in good time, usually 30 days in advance. If you do not agree to the new prices, you can cancel before the adjustment takes effect.

7. Term and cancellation

Subscriptions run monthly and renew automatically. You can cancel at any time with effect from the end of the current billing period. Cancellation is done via the account settings or by email to the provider. After cancellation, access remains available until the end of the paid period.

8. User obligations

You use kinux exclusively for legally permitted purposes. The following in particular are not permitted:

In case of a violation of these obligations, the provider may block access without prior notice or terminate the account.

9. Availability

The provider aims for the highest possible availability of the service but does not guarantee uninterrupted operation. Maintenance work, technical faults or events beyond the provider’s control may lead to temporary interruptions. Temporary interruptions do not give rise to any claims for price reductions or damages.

10. Warranty and liability

kinux provides information on insurance topics. The completeness, currency and accuracy of the answers are not guaranteed. Using the service does not replace advice from a qualified professional.

The provider’s liability for direct or indirect damage arising from the use of the service or the inability to use it is excluded to the extent permitted by law. This exclusion does not apply to damage caused by gross negligence or intent on the part of the provider.

11. Data protection

The processing of personal data is governed by the kinux privacy policy. We recommend reading it before use.

12. Data export and deletion at the end of the contract

You can export your data from your account at any time. If your subscription ends, the export remains available until your account is deleted. If you delete your account, your personal data is deleted in accordance with the privacy policy. The export is free of charge and provided in a common, machine-readable format.

13. Use by organisations

If you use kinux within an organisation with several user accounts, the data processing agreement between kinux and the organisation applies in addition. The export and deletion periods agreed there apply to organisation data after the end of the contract.

14. Changes to the service

We continuously develop kinux. We will inform you by e-mail at least 30 days in advance of essential changes that considerably restrict your use. We will inform you at least 60 days in advance of any relocation of data processing to another country. If you do not agree with such a change, you can terminate your subscription as of the date the change takes effect.

15. Changes to these terms

The provider may adapt these terms. You will be informed of material changes in good time, usually 30 days in advance, by email. If you do not agree to the changed terms, you can cancel the service before they take effect. Continued use after they take effect counts as acceptance.

16. Applicable law and jurisdiction

Swiss law applies exclusively, excluding the conflict of law rules of private international law. The exclusive place of jurisdiction is Thun (Canton of Bern), unless the law provides for a mandatory place of jurisdiction.
